1. Fees
a. Stimulation classes are charged for on a monthly basis (either once or twice per week classes). Payment for classes is due by the 5th of each month.
b. If payment is not received by the 5th of the month, a late fee will be charged to the client for each week late.
c. The client is required to settle their account before continuing with classes.

2. Attendance to Classes:
a. Registration: Registration for classes is on a first-come, first-served basis. Completing payment confirms your registration.
b. If you or your little one displays any signs of illness, kindly stay at home. The health and safety of our clients is our highest priority.
c. We are a photo taking zone. If you do not wish photos of your child to be posted on our platforms, kindly advise us of such. (Either on your WhatsApp group or via email)

d.Should you or your little one exhibit signs of illness, please stay at home. The health and safety of all our clients is of the utmost importance to us.

3.Cancellation:
No refunds will be issued for cancellations made by the client.
Classes are charged for on a monthly basis, regardless of attendance. If you would like to cancel, you will need to provide Little Bright Fox with one calendar month notice.
A pay per class option is available. We require notice for your attendance to ensure there is space available. Clients who pay monthly are prioritised. A spot is not guaranteed.
Refunds/ credits will not be processed for missed classes.
Should a class be cancelled on our part, we will arrange for you to attend a make-up class. 1 reschedule will be arranged.

4.Rescheduling:

Classes can be rescheduled based on availability and with advance notice. We will arrange one rescheduled class for a class that is cancelled on our part. We try to ensure the rescheduled date and time works for the majority.

Class Changes: We reserve the right to cancel or reschedule classes. In such cases, participants will be notified, and refunds or rescheduling options will be provided.

5. Price Increase Notice:
a. Notice Period: Customers will be notified of any price increases at least 7 days before the changes take effect.

b. Communication: Price increase notices will be sent via email to the address provided during the registration or purchase process.

6. General:
a. Liability: Little Bright Fox is not liable for any injuries, damages, or losses incurred during classes, events, or product use.

b. Privacy: Customer information will be handled in accordance with our Privacy Policy.

c. Modification of Terms: We reserve the right to modify these terms and conditions at any time. Changes will be effective upon posting.

Terms and Conditions for Sales

1. Retail Sales:
Payment confirms acceptance of terms & conditions.
a. Product Availability: All products displayed for sale are subject to availability. We reserve the right to limit the quantity of products sold.

b. Pricing: Prices are subject to change without notice. The price charged will be the price in effect at the time of the order.

c. Payment: All payments must be made in full at the time of purchase. We accept cash, card and EFT payments.

d. Order Confirmation: An order confirmation will be sent to the email address provided during the checkout process.

2. General
a. Agreement: These terms and conditions constitute a legally binding agreement between Little Bright Fox (“Seller”) and the customer (“Buyer”).
b. Acceptance: By making a purchase, the Buyer agrees to be bound by these terms and conditions.
3. Orders and Payments
a. Order Placement: Orders are subject to acceptance by the Seller. The Seller reserves the right to refuse or cancel an order for any reason.
b. Pricing: All prices are quoted in South African Rand (ZAR) and include/exclude Value Added Tax (VAT) as applicable. Prices are subject to change without prior notice.
c. Payment: Payment must be made in full before the goods are dispatched. The Seller accepts [list accepted payment methods].
4. Delivery
a. Delivery Time: Delivery times are estimates and are not guaranteed. Delays may occur due to unforeseen circumstances.
b. Delivery Charges: Delivery charges are specified at the time of purchase and are the responsibility of the Buyer.
c. Risk of Loss: The risk of loss or damage to the goods passes to the Buyer upon delivery.
5. Returns and Refunds

a. Force Majeure: The Seller is not liable for any failure to perform its obligations due to causes beyond its reasonable control.
b. Modification of Terms: The Seller reserves the right to modify these terms and conditions at any time. Changes will be effective upon posting.

By making a purchase, the Buyer acknowledges that they have read, understood, and agreed to these terms and conditions.

LIABILITY CLAUSE

1. Limitation of Liability:
a. Product Liability: Little Bright Fox shall not be liable for any injury, damage, or loss arising out of the use of, or inability to use, the products sold. The Buyer acknowledges that the use of the products is at their own risk.
b. Services Liability: For services provided, Little Bright Fox shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or the inability to use the services.
2. Warranty Limitation:
a. Goods: The Seller’s liability for defective goods is limited to the replacement or repair of the goods or a refund of the purchase price, at the Seller’s discretion.
b. Services: The Seller’s liability for any defects in services is limited to re-performance of the services or a refund of the service fees, at the Seller’s discretion.
3. Third-Party Products or Services:
a. Endorsement Disclaimer: Little Bright Fox does not endorse or assume any liability for the products or services offered by third parties that may be mentioned or linked to on our platform.
4. Force Majeure:
a. Little Bright Fox shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, labour disputes, governmental restrictions, or natural disasters.
5. Indemnification:
a. The Buyer agrees to indemnify and hold Little Bright Fox its officers, directors, employees, and agents harmless from any claims, losses, damages, liabilities, or expenses (including legal fees) arising out of the Buyer’s use of the products or services.
6. Governing Law and Jurisdiction:
a. This limitation of liability is governed by the laws of South Africa. Any disputes arising from this limitation of liability shall be subject to the exclusive jurisdiction of the courts in South Africa.
7. Modification of Liability Clause:
a. Little Bright Fox reserves the right to modify this limitation of liability at any time. Changes will be effective upon posting.
b. By making a purchase, the Buyer acknowledges and agrees to the limitations of liability set forth in these terms and conditions.
